Gunman's mom owned weapons in school massacre

Investigators believe the gunman shot his mother at home, where he lived with her, and are researching the suspected gunman's writings, looking for any clues as to what might have precipitated one of the worst mass shootings in history. NBC's Pete Williams reports.

The weapons used in Friday?s shooting at Sandy Hook Elementary School in Newtown, Conn., were legally purchased and registered to Nancy Lanza, the mother of the gunman, Adam Lanza, two law enforcement officials told NBC News. ?

The gunman was clad in black and used two 9mm pistols to kill 20 small children and six adults at the school.?It was unclear how many shots were fired there.?

Two 9mm handguns, one made by Glock and the other by Sig Sauer, were recovered inside the school. An AR-15-type rifle also was found at the scene, but there conflicting reports Friday night whether it had been used in the shooting.


In total, 28 people died in Friday's rampage, including the gunman, who was found at the scene, and another victim, apparently shot dead at a home in Newtown. Nancy Lanza, the mother of the gunman, was a teacher a the school.

Under Connecticut law, people under 21 are prohibited from purchasing or carrying handguns. Lanza was 20.

U.N. nuclear inspectors in Iran, no sign of Parchin visit

DUBAI (Reuters) - U.N. nuclear inspectors were in Tehran on Thursday for talks on Iran's disputed atomic activities but there was no sign they would gain access to the Parchin military complex as requested.

The Iranian Students' News Agency (ISNA) said the seven-member International Atomic Energy Agency delegation headed by deputy director general Herman Nackaerts would meet Iranian nuclear officials.

"No plans were announced yet for inspectors to visit Iran's nuclear facilities or other sites," ISNA said, without giving a source. There was no immediate word on whether the planned one day of talks had any concrete outcome.

The talks are the first between the U.N. agency and Iran since August when the two sides failed to make any progress on a long-stalled IAEA investigation into suspected atom bomb research in the country.

The meeting could give some indication whether Iran - which denies it wants to develop such weaponry - is more willing to address international concerns over its nuclear work after U.S. President Barack Obama's re-election last month.

Israel has threatened military action if diplomacy and economic sanctions intended to halt Iran's uranium enrichment activities fail to resolve the long-standing dispute.

Iranian state media reported that the inspectors arrived early on Thursday but did not say whether the meeting had actually started. The main state television news broadcast in the evening did not mention the IAEA visit at all.

The IAEA wants an agreement that would enable its inspectors to visit the Parchin military complex and other sites that it suspects may be linked to what it has called the "possible military dimensions" to Iran's nuclear program.

The agency believes Iran has conducted explosives tests with possible nuclear applications at Parchin, a sprawling facility southeast of Tehran, and has repeatedly asked for access.

NEW PARCHIN "LAYOUT"?

Iran says Parchin is a conventional military site and has dismissed allegations that it has tried to clean up the site before any visit.

Western diplomats say Iran has carried out extensive work at Parchin over the past year - including demolition of buildings and removal of soil - to cleanse it of any traces of illicit activity. But the IAEA said a visit would still be "useful".

A U.S. think-tank said late on Wednesday that new satellite imagery showed "what appears to be the 'reconstruction' phase" of the site at Parchin that the IAEA wants to see, following "considerable alterations" there earlier in the year.

"A new site layout is taking shape and the presence of dirt piles and a considerable number of earth-moving vehicles and cars suggest that construction is continuing at a steady pace," the Institute for Science and International Security said.

It said imagery dated December 9 indicated a new, almost completed security perimeter around the site: "Notable are further changes to the two major buildings at the site which appear to have been covered with white or grey roofing."

When he left Vienna on Wednesday, Nackaerts said the team hoped to gain access to Parchin. Other members of the delegation carried what appeared to be cases of inspection equipment.

A senior member of Iran's parliament made critical remarks about the U.N. nuclear watchdog, accusing it of relying on "unreliable" reports by its foes' spy services.

"As long as the agency has a political view ... and as long as it trusts unreliable reports from American, British and (Israeli) spying agencies ... it is natural that the numerous travels of the agency's inspectors will not lead to positive results," lawmaker Hossein Naqavi Hosseini told parliamentary news agency Icana.

The IAEA's talks with Iran are separate from - but closely linked to - efforts by six countries to resolve the decade-long nuclear dispute.

On Wednesday, senior European Union and Iranian diplomats discussed the timing of possible new talks between Iran and Britain, France, Germany, United States, Russia and China.

Police foil terrifying murder plot against Justin Bieber

Justin Bieber was the target of a grisly murder plot hatched by a convicted killer imprisoned in New Mexico, police told ABC News today.

Dana Martin, 45, an inmate at the Southern New Mexico Corrections Facility, is accused of masterminding the plan, which called for castrating Bieber and his bodyguard in New York, and two unnamed victims in Vermont, before strangling them, according to a New Mexico State Police affidavit.

Martin, who was sentenced to 978 years in jail for rape and murder in 2000, had an image of Bieber tattooed on his leg and plotted to kill him after his attempts to contact the 18-year-old pop star failed, according to the affidavit, which also alleged he orchestrated the plot to achieve notoriety.

Former inmate Mark Staake and his nephew, Tanner Ruane, set off for Vermont on Nov. 14 to carry out the plan, intending to continue on to New York, according to the affidavit. They intended to catch Bieber between his Nov. 28 and 29 Madison Square Garden concerts.

The three now stand accused of two counts each of conspiracy to commit murder and two counts each of conspiracy to commit aggravated battery, according to Lt. Robert McDonald of the New Mexico State Police. New Mexico is awaiting Staake and Ruane's extraditions from the East Coast. McDonald did not know whether they had retained legal representation.

Martin wanted Ruane to attack the victims with Fiskars "Durasharp" gardening clippers, and offered to pay Ruane $2,500 for each testicle he got, the affidavit alleged.

It added that Martin wanted the intended victims strangled with a paisley necktie, just as Martin had done in a prior crime.

He referred to the murders as "the whole putting down of the 'dogs,'" the affidavit said.

Staake, who was released in October after serving time for burglary, and Ruane left Albuquerque for Vermont, where they had plotted to kill the two unidentified victims, according to the affidavit.

However, before committing any killings, the pair missed a highway exit in Vermont near the border crossing into Canada and got stopped by a border patrol agent, according to the affidavit. Staake was arrested in Vermont on outstanding warrants.

Ruane was released, but New York State Police later arrested him after officials eavesdropped on a phone call in which Ruane and Martin allegedly made references to the murder plots, the affidavit said.

The car in which Ruane and Staake had been stopped was found to contain the pruning shears.

When prison authorities confronted him, Martin allegedly detailed the plan and gave them a hand-drawn map of where Ruane and Staake had traveled.

A representative for Bieber released this statement to ABC News: "We take every precaution to protect and ensure the safety of Justin and his fans."

YAP is a Filipino operating under the business name DECO COMMERCIAL with residential address at 1677 Purok Manga, Sto. Ni?o (Pob.), Panabo City, Davao del Norte and business address at Brgy. Sto. Ni?o, Panabo Central Market, Panabo City, Davao del Norte. He is engaged in the business of sale of hardware and construction materials.
YAP was the subject of a tax audit/investigation by the BIR pursuant to Electronic Letter of Authority (eLOA) Nos. 201000005893-94. Pursuant to the said eLOAs, investigators obtained third-party information from Holcim Philippines, Incorporated (HOLCIM) whose certification disclosed that YAP made purchases from the company in 2009 and 2010 amounting to P82.45 million and P86.04 million, respectively. YAP failed to declare said purchases with the BIR.

A comparison of his declared gross income per ITR for TY 2009 and 2010 of P4.84 million and P5.29 million, respectively, with the income per investigation by the BIR of P96.84 million and P115.23 million in 2009 and 2010, respectively, showed a substantial under-declaration of 1,898% or P92.00 million for TY 2009 and 2,076% or P109.94 million for TY 2010.

Likewise, a comparison of his declared sales per VAT returns for TY 2009 and 2010 of P4.99 million and P5.29 million, respectively, with the taxable sales per investigation by the BIR of P96.84 million in 2009 and P115.23 million in 2010 disclosed a gross underdeclaration of 1,839% or P91.85 million (2009) and 2,076% or P109.94 million (2010).

Under Sec. 248 (B) of the Tax Code, an under-declaration of taxable income by more than 30% constitutes a prima facie evidence of a false or fraudulent return.
YAP was sued for an estimated aggregate tax liability amounting to P172.80 million, inclusive of surcharges and interests, broken down into: P83.63 million ? 2009 (Income Tax ? P59.85 million; and VAT ? P23.78 million); and P89.17 million ? 2010 (Income Tax ? P64.37 million; and VAT ? P24.80 million).

The two cases against ERNESTO Y. YAP are the 139th and 140th filed under the Run After Tax Evaders (RATE) program of the BIR under the leadership of Commissioner Kim S. Jacinto-Henares. They are likewise RATE cases of Revenue Region No. 19, Davao City. (reytdlc)

Egypt opposition fears violence from Brotherhood

CAIRO (AP) ? They showed a military-style precision: Crowds of bearded Islamists proclaiming allegiance to Egypt's President Mohammed Morsi and chanting "God is great" as they descended on tents set up by anti-Morsi protesters outside the presidential palace, swinging clubs and firing rifles. They set up a detention facility, interrogating and beating captured protesters.

The scene from bloody clashes outside the presidential palace a week ago hangs over Egypt's political crisis as a daunting sign of how much more violent the confrontation could become between Morsi's Islamist supporters and the opposition that has launched a giant wave of protests against him.

Opponents of Morsi accuse his Muslim Brotherhood supporters of unleashing highly trained cadres ? fired up with religious slogans ? to crush their political rivals. They fear last week's violence was a signal that the Brotherhood will use force to push its agenda and defend its political gains in the face of a persistent protest movement demanding that Morsi withdraw a draft constitution largely written by his Islamist allies.

Ahead of a new mass rallies planned by both sides Tuesday, masked gunmen attacked anti-Morsi protesters in Cairo's central Tahrir Square before dawn, firing birdshot at them and wounding nine. It was unclear who was behind the attack, said security officials, speaking on condition of anonymity because they were not authorized to talk to the press.

Officials from the Brotherhood and its political party deny using violence to quell critics. Regarding the clashes last Wednesday, the worst violence yet in the crisis, they say Morsi supporters were defending the palace and accuse the protesters of starting the battles. They claim their side suffered more deaths and injuries during the clashes, which left at least eight people dead. More broadly, the Brotherhood accuses former regime supporters of paying thugs in an organized campaign to topple Islamists from power, pointing to a series of attacks on Brotherhood offices the past weeks.

"The group and the party don't use violence and have no inclination to the use of violence," said Mourad Aly, a Brotherhood party spokesman. He added, "We will never allow an attack or breach on the palace."

However, when last week's violence began, the only protesters outside the palace were around 100 conducting a sit-in in the tents, and the allegiances of those killed remain controversial. Opponents and rights lawyers charge that the Brotherhood has tried to convince some families to declare their deceased sons as Brotherhood.

Testimonies and videos that have emerged from the nearly 15 hours of street clashes show an organized group of disciplined Islamists, working in units and carrying out military-type exercises as they broke up the tent sit-in at the palace.

Opponents of the Brotherhood frequently accuse the group of running a "militia." The group is known for its tight discipline, and it acknowledges that many of its young members undergo organized martial arts training ? but it vehemently denies forming any militias.

Tharwat el-Kherbawy, a former Brotherhood member and now an opponent of the group, said the Brotherhood's central organizational doctrine ? calling on members to "hear and obey" their leaders ? gives it a military-like structure.

When the Brotherhood met a stronger than expected protest movement, "they had no hesitation in hastening to implement their ideas and resorting to violence," he said. "If their empowerment project is facing resistance, this resistance must be quelled."

Wednesday's showdown was the fiercest display of the Brotherhood's strength, but similar, smaller attacks on opponents by Brotherhood members took place at least three times earlier this year when secular and liberal groups criticized the Brotherhood's grip on power.

During last Wednesday's fighting, nearly 140 anti-Morsi protesters were tortured and interrogated at a makeshift detention center set up by the Brotherhood along the walls of the presidential palace, according to witnesses. The detained protesters were filmed making forced confessions that they had received foreign funds, according to some who were held and an Egyptian journalist who snuck into the site.

One of the victims, Yehia Negm, an Egyptian diplomat, told The Associated Press he was dragged on the ground to the center where he was beaten. He is suffering from multiple injuries in the head, eye, nose, and ribs from beating and had remains of pellets in his forehead from gunfire during the clashes.

"When they found my ID that says a diplomat, they started accusing me of working with security agencies, of being a spy and of serving foreign countries," Negm said. "They rained beatings down on me. They started yelling at me, saying, 'You infidels, you want to burn the country down, you are not Muslims.'"

Around 20 Islamists manned the center, made up of metal barricades erected against the palace wall, said Mohammed Elgarhy, a local journalist with the daily Al-Masry Al-Youm who snuck in and spent nearly four hours there. Among them was a man he recognized as a well-known Brotherhood lawyer and two others he overheard speaking with a Brotherhood leader. The others, who he said he believed were Brotherhood members, carried out the beatings and interrogations.

"The Brotherhood were carrying out the job of the Interior Ministry," Elgarhy told AP. "They would arrest anyone they suspected ... asking them questions such as who paid for you to come here."

Troops from the Central Security Forces guarded the site, but did not interfere, he said. The Brotherhood has not addressed accusations about the detention center but says it did seize protesters and hand them over to police.

The violence came a day after hundreds of thousands marched on the palace in Cairo's upper middle class district of Heliopolis, demanding Morsi withdraw the draft constitution and sweeping powers that he had given himself in a series of decrees.

After the rally, around 100 protesters remained in the tent camp. In response, the Brotherhood called a "general mobilization" of its members, and its spokesman said the group will protect the legitimacy of the president and state institutions.

The next day, last Wednesday, thousands of Islamists lined up on a main boulevard near the palace, chanting "Power, Resolve, Faith, Morsi's men are everywhere," and threatening to douse the tents with gasoline, according to video of the scene posted on YouTube.

The Islamists then stormed the camp, chanting "God is great" and "Islamic law is fundamental in Egypt," as they tore down tents and chased away the protesters. They then ransacked the tents. Brotherhood supporters claimed they found evidence of drug use at the camp ? though they never showed any ? and that burnt charcoal and processed cheese in the tents proved the protest was foreign funded, without explanation. The accusations were reminiscent of those leveled by the regime of ousted President Hosni Mubarak against the protesters who rose up against his rule in early 2011.

As news of the attack spread, more anti-Morsi protesters arrived on the scene. Buses, shown parked nearby in videos, brought in Brotherhood supporters. By sunset a full-fledged street battle transformed Heliopolis into a war zone, spreading over at least three fronts near the palace. Protesters and witnesses put the number of Morsi supporters at up to 12,000 compared to several thousand protesters.

Bearded men in short robes waved sticks in the air as they chased groups of young men and women down darkened alleys while gunfire echoed in the background.

A resident of a building overlooking one front line said Morsi supporters appeared to be operating by what a well-rehearsed plan. They came prepared with metal sheets for barricades and motorcycles with small trailers attached brought loads of stones to pelt protesters with. The resident spoke on condition his name not be used for fear of retribution.

Some Morsi supporters were armed with rifles, firing from the edges of the front lines to avoid being detected, said Mahmoud Zaghloul, a 22-year old protester who got hit with a rock in his head. He also said many in the Morsi camp came prepared with helmets with plexi-glass face screens.

At least one video shown on a private TV station shows a man in the Morsi camp, wearing a full helmet, taking a professional shooter position, bending his knees and aiming with a rifle.

"One of the most disturbing things was how they chanted 'God is Great' as they aimed at us," as if they were firing at infidels, Zaghloul said.

Some in the anti-Morsi camp also had firearms, witnesses said. At least one amateur video circulating online that showed an anti-Morsi protester pointing a pistol from behind a barricade at the opposing camp.

The exact circumstances of the online videos could not be independently confirmed, but their contents were consistent with other AP reporting.

The National Federation of Independent Business tried to shock the world with its report that small-business owner optimism plunged 5.6 points to 87.5%?below the 87.8% of the apocalyptic post-Lehman November 2008. A huge setback; small businesses are the job creating machine of the economy. ?Something bad happened, and it wasn?t Sandy,? said NFIB chief economist Bill Dunkelberg. ?It was the election.?

Small-business Optimism took a nasty hit during the financial crisis?and hasn?t recovered yet. When NFIB started the monthly surveys in 1986, it set the level at 100. Optimism would drop into the 90s then bounce back above 100. From late 2003 through 2004, peaks approached 110. But in 2005, Optimism faded. It dipped below 90 for the first time in March, 2008, as Bear Stearns blew up. By September, it was back at 92.9, the high for the year. Despite Lehman?s collapse.

Small-business owners apparently liked that Wall Street got clobbered. As markets nosedived, however, optimism followed. In October 2008, it dropped 5.4 points to 87.8, rose a smidgen in November, then descended to its low of 81.0 in March, 2009.

Recovery of small-business Optimism was only slight, unlike the markets that were goosed by the trillions that the Fed handed to its cronies. Small businesses got no more than crumbs. By April 2010, Optimism ventured above 90, then dropped again. In February, 2011, it reached a post-crisis high of 94.5, dropped again, hit that high once more in April, 2012, then dropped and finally hit 87.5% in November. A tough slog.

The most significant factor in November?s plunge?? ?The expectation that future business conditions will be worse than current ones,? Dunkelberg explained, the Outlook for General Business Conditions having crashed from +2% to -35%?worse than anything during the crisis. A ?poisonous climate for investment and expansion,? Dunkelberg said. ?

Problems were lurking everywhere, such as inventories that were too high, but some sub-indices, particularly for ?actual? sales and earnings, weren?t all bad, given the debacle of the post-crisis years. Credit was plentiful. Actual and planned job openings continued to tick up, as did hiring plans. Bad news for workers though: planned compensation has been dropping this year, after a feeble recovery from crisis lows.

In this manner, the details, graphs, and tables of the report don?t paint a picture of the sudden apocalypse that the headline number promised?but of a long-term depression that started in 2005 and has improved only a few notches since the trough of the crisis! All in an economy whose growth is ?lumpy? [read... It?s Official: The Consumer Is Alive and?Dead].

But what jumps out already in the introduction is a political agenda rather than objective interpretation of data: ?Between the looming ?fiscal cliff,? the promise of higher healthcare costs, and the endless onslaught of new regulations, owners have found themselves in a state of pessimism. We are forced to ask: is this the new normal?? So who are these ?owners,? and who is ?we??

A lobbying and advocacy organization with offices in Washington DC and all state capitals, NFIB claims to be ?nonpartisan? despite its support for Republican candidates. Its PAC, the SAFE Trust (Save America?s Free Enterprise Trust), is ?the most powerful and effective small business political action committee in the country.? Among NFIB?s many, often laudable, causes was its fierce opposition to the Patient Protection and Affordable Care Act, or Obama-care; it joined 26 states in the lawsuit that challenged its constitutionality. And lost when the Court upheld most provisions.

With 350,000 members?of the 6 - 30 million small businesses in the US, depending on who is being counted?the organization represents between 1.2% and 5.8% of all small-business owners. These members received the surveys that would lead to the report. Of the 3,938 responses, 733 were deemed ?useable.? They represented companies ranging from one-employee operations (10%) to companies with more than 40 employees (7%).

The data collected from the ?useable? responses was further trimmed by excluding the results from the ?Sandy States,? namely ?NJ, DE, NC, DC, VA, WV, MD, MA, CT, and eastern portions of PA and NY.? Even though there were ?no significant differences? in states impacted by Sandy?capital spending plans were ?slightly higher,? labor force indicators ?slightly worse,? etc.?the report comes to the conclusion that the decline in Optimism wasn?t related to Sandy but ?the resolution of the election.? And it used the trimmed and manipulated results to lash out against President Obama.

?The ?war? on success is now public policy as the President insists on higher tax rates for the ?rich,? those making $250,000 or more,? Dunkelberg states. ?He continues to obfuscate by claiming that only 3% of small-business owners will be impacted, as if even those are not a concern.? Hence, the sudden and apocalyptic post-election decline in small-business optimism. But the long shadow of a political agenda darkens the validity of the data?just when we need accurate data the most.

California Governor Brown treated for early stage prostate cancer

SACRAMENTO (Reuters) - California Governor Jerry Brown is undergoing treatment for early stage prostate cancer with an excellent prognosis for recovery, and the 74-year-old Democrat is expected to keep up a full work schedule, his office said on Wednesday.

"Fortunately, this is early stage localized prostate cancer, which is being treated with a short course of conventional radiotherapy," Dr. Eric Small, Brown's oncologist, said in a statement.

"The prognosis is excellent, and there are not expected to be any significant side effects," he added.

Brown, who had a cancerous growth removed from the right side of his nose in April 2011, will complete that treatment in early January, his office said, and is expected to keep a full work schedule.

During Brown's outpatient cancer treatment in 2011, doctors removed basal carcinoma cells and did reconstructive surgery to his nose.

Brown previously served two terms as governor of California from 1975 to 1983, and at age 36 he became one of the youngest governors of the state. He returned to that office in 2011 and is now the oldest governor the state has ever had.

Jordan's king orders release of jailed protesters

AMMAN, Jordan (AP) ? Jordan's king has ordered the release of 116 protesters jailed for their involvement in last month's violent rallies against hikes in fuel prices.

The wave of protests across the country in November had featured rare calls for deposing Abdullah II.

Three people were killed and 75 others, including 58 policemen, were injured in the violence as prices for heating and cooking gas went up by 54 percent, and some oil derivatives by up to 28 percent.

Information Minister Sameeh Maaytah said on Tuesday that 13 other detainees, charged with criminal conspiracy and vandalism, were not included in the pardon.

The kingdom's Petra news agency said Abdullah issued the pardon late Monday.

Jordan has largely been spared the mass demonstrations that have toppled four Arab leaders during the Arab Spring uprisings.

Daily Kos: What Obamacare means for businesses: Facts vs. fiction

It's the law.

A number of high profile conservative business owners have made a lot of news lately over their threats to cut back workers hours and even lay people off as a result of Mitt Romney's election loss, and the certainty that the Affordable Care Act is going to be implemented. For some, those pronouncements provided a strong enough backlash among customers that they've had to backtrack, attempting to end the bad publicity by not being terrible employers.

Those are the really high profile cases; the business owners who are obnoxious enough to publicly threaten their employees and to tell the world what rotten employers they are. Because of them, because of Fox News, because of a lack of good public education about the Affordable Care Act from the administration and supportive members of Congress, other business owners, especially small business owners, are left with the idea that maybe this Obamacare is just going to be too expensive and too burdensome. That's a big problem, especially for employees of small businesses. Because for those businesses there are some pretty good deals.

Follow me over the jump to see how businesses, small and big, will be affected by Obamacare, and why some of the loudest complainers are the most full of it.

Small business

The smallest employers are not only exempt from any potential fine for not providing insurance, if they do or want to provide insurance to employees, they can get tax credits to help do that. That's in effect now for companies with few than 25 employees and wages below $50,000 each. If they offer insurance and pay at least half the premiums, they can receive a tax credit of up to 35 percent of their contributions. After 2014, the tax credit goes up to 50 percent if the business buys coverage through the insurance exchange. Companies that have up to 50 employees and who do not provide health care benefits are not subject to any fines for not providing that coverage. Their employees will be able to get their coverage in the health exchanges the law creates starting in 2014.

Here's one of the greatest things for small business owners: they can afford health insurance for themselves! The Kaiser Family Foundation surveyed large and small businesses this fall for their regular Employer Health Benefits Survey. Their findings for small business owners were striking.

  • About one in four small business owners is uninsured, roughly the same as for non-elderly adults generally.
  • Just 40% of small business owners get job-based insurance, either from their own job or through a family member. In contrast, almost six in ten non-elderly adults get their insurance through an employer.
  • Small business owners rely heavily on the individual insurance market, with 30% of them buying ?other private insurance? (the vast majority of which is coverage purchased in the individual market).

[...] In fact, an estimated 60% of small business owners now buying insurance in the individual market have incomes up to 400% of the poverty level and would be eligible for tax credits in exchanges or Medicaid, and 83% of owners who are now uninsured would be eligible for subsidized coverage (split about equally between tax credits and Medicaid).

These are the job creators, the folks conservative so laud. And they're struggling just as hard as anyone else to find good, affordable health insurance, with 30 percent of them (at least) paying a boatload of money to do it. Now they'll be able to afford health insurance. Maybe they'll even be able to expand their businesses, hire more people, and grow this economy for

Big business

For employers with 50 or more employees, well, yes, they'll have to decide whether they want to be good citizens, good employers, and ultimately save taxpayers and themselves money, and provide health insurance. These are the employers that will have to pay a penalty if they do not provide health insurance for their full time employees:

or don't pay a significant portion of their employees' coverage.
This is the penalty that the Obamacare haters are screaming about now, that they are threatening their employees over now. Even though these changes don't take place until 2014. Even though the penalties are not in place now. Even though it's pretty much only companies within the health care industry that face any additional tax burden (and indoor tanning salons, arguably not the most effective "sin" tax) and?here's the crux of the matter for these corporate opponents?wealthy individuals who will eventually be paying the tax bill for Obamacare.

Individuals making more than $200,000 a year will see a 0.9 percent increase in the Medicare payroll tax paid beginning next year. That same two percent of the population will be subject to a 3.8 percent surtax on investment income. Beginning in 2018, there's going to be a big tax hike on high-value health insurance plans, those above $10,200 for an individual plan and $27,500 for a family plan.

But let's get back to those penalties companies will have to pay beginning in 2014, and focus particularly on the businesses that have been most vocal about how the law is going to break them. At HealthBeatBlog.com, Maggie Mahar sums up analysis by other health care writers and economists on just what the costs might be for specific restaurant chains.

Managed Care Matters? Joe Paduda recently took a hard look at the numbers that led Papa John Pizza founder and CEO John Schnatter to announce that he?s going to have to hike the price of his pizzas by 10 to 14 cents to cover the added cost of complying with Obamacare?s provisions.

?Turns out that it?s only 3.4 to 4.6 cents? for an average-sized pie,? Paduda observes. ??Let?s think about that,? he continues. ?Fourteen cents a pizza gets all of his employees excellent health coverage (only about a third are covered now), even though Schnatter says he?d ?like to cover all of them.??

Over at Forbes, Caleb Malby eyeballed Schnatter?s balance sheet and confirms Paduda?s appraisal: Obmacare does not constitute a major threat to profit margins. ?Last year, Papa John?s International captured $1.218 billion in revenue,? he reports. ?Operating expenses were $1.131 billion.? Schnatter claims that Obamacare will his cost his company $5-8 million annually. ?If Schnatter?s math is accurate,? Malby writes, ? the new regulation translates into a .4% to .7% (yes, fractions of a percent) expense increase.?

?Using Schnatter?s figures,? he concludes, ?the costs his company will incur due to Obamacare are not equal to the price increases he mentions. Those increases would more than make up for damage done to the company?s net income through increases to operational expenses.?

Here's a thought for these companies: having healthy employees, who feel that their employer gives a shit about their well-being might just increase job satisfaction, and might just decrease absenteeism and employee turnover, increase productivity, and with all that, might just increase profits. It could happen.

So if your employer, particularly if your employer has 25 or fewer employees, is telling you that your hours have to be cut or your job is in jeopardy in 2013, they are likely very full of shit. Because their profits are not endangered now. They're not making smart business decisions. They're making vindictive political ones.

Unions prepare for protest at Michigan Capitol

DEARBORN, Mich. (AP) ? More than 200 activists attended training Saturday in preparation for a protest at the Michigan Capitol, where lawmakers are putting the final touches on legislation that would allow workers to stop paying union dues.

Between chants, cheers and applause, organizers warned those at the training to be prepared for insults and obstruction Tuesday in Lansing. The volunteers lined up on opposite sides of a long hall at UAW Local 600 in suburban Detroit and took turn turns portraying protesters and union critics.

"Humanize the situation. Be clear with your intentions. Introduce yourself," national labor activist Lisa Fithian, of Austin, Texas, said through a megaphone. "They're going to do everything they can to criminalize us."

Republicans who control the Michigan Legislature passed legislation Thursday that would allow workers to opt out of paying union dues at businesses where employees are represented by a union. The final version is expected to win approval soon and be signed by Gov. Rick Snyder, also a Republican. Protests and possible civil disobedience are planned because the law would pose a major financial blow to organized labor.

"We are not the violent ones," Fithian told the crowd. "What is it that the police are going to do? What is it that the governor is going to order? ... We have to remember: The police are not our enemy in this fight. They're doing a job. It's our job to convince them that they should put their guns down and join the people."

The meeting, which was attended by UAW President Bob King, lasted more than two hours, but reporters were allowed to watch just a portion.

Mark Coco, 27, a graduate student at Wayne State University, said he would protest in Lansing. He recently worked on a failed campaign to put collective bargaining rights in the state Constitution.

"This is the first time I've ever been involved in this. I'm trusting that it pay dividends," Coco said in an interview. The legislation "is a way to divide workers, divide colleagues."

Katie Oppenheim, the head of a union local that represents 4,500 nurses at University of Michigan Health System in Ann Arbor, said workers whose pay and benefits are negotiated by a union should pay dues.

She believes her members appreciate the fruits of collective bargaining and will keep paying. But she acknowledged "the reality that people like things for free."

The legislation has already been challenged in court by a union activist who claims the state Open Meetings Act was violated when Michigan State Police barred the doors to the Capitol on Thursday. Ari Adler, a spokesman for Republican House Speaker Jase Bolger, told the Detroit Free Press the lawsuit was "baseless and frivolous" and "more about receiving attention than getting justice."

A hearing on the lawsuit has been scheduled for Thursday, but union activist and Highland Park school board member Robert Davis told the newspaper he would request an earlier date.

Egyptian military says only dialogue can avert disaster

CAIRO (Reuters) - Egypt's military, stepping into a crisis pitting Islamist President Mohamed Mursi against opponents who accuse him of grabbing excessive power, said on Saturday only dialogue could avert "catastrophe".

State broadcasters interrupted their programmes to read out an army statement telling feuding factions that a solution to the upheaval in the most populous Arab nation should not contradict "legitimacy and the rules of democracy".

That sounded like a swipe at protesters who have besieged the palace of the freely elected president and called for his removal, going beyond mainstream opposition demands for him to retract a decree that expanded his powers.

The statement also called for a "serious" national dialogue - perhaps one more credible than talks convened by Mursi on Saturday in the absence of opposition leaders. They insist he must first scrap his November 22 decree, defer next week's popular vote on a new constitution and allow the text to be revised.

Deep rifts have emerged over the destiny of a country of 83 million where the end of Hosni Mubarak's 30 years of military-backed one-man rule led to a messy army-led transition, during which the Muslim Brotherhood and its allies won two elections. Many Egyptians crave stability and economic recovery.

The spokesman for the main Islamist coalition demanded that the referendum go ahead on time on the constitution drafted by an Islamist-led assembly from which liberals had walked out.

The army, which ran Egypt for months after Mubarak fell in February 2011, again cast itself primarily as the neutral guarantor of the nation. A military source said there was no plan to retake control of the country or its turbulent streets.

"DARK TUNNEL"

"The armed forces affirm that dialogue is the best and only way to reach consensus," the statement said. "The opposite of that will bring us to a dark tunnel that will result in catastrophe and that is something we will not allow."

Mursi's office said the president opened his "national dialogue" with about 40 political and other public figures discussing "means to reach a solution to differences over the referendum...and the constitutional decree".

Prime Minister Hisham Kandil told an Egyptian television channel that the talks had led to creating a committee to review Mursi's November 22 decree and to work out legal ways to postpone the referendum. He said a new decree could be issued.

"All options are on the table to reach consensus," he said, adding that it was vital to take action to shore up Egypt's economy that has been battered by the turmoil.

The main opposition coalition, the National Salvation Front, which boycotted Mursi's dialogue repeated its call on Saturday for scrapping the decree and the referendum on the constitution.

Instability in Egypt worries the West, especially the United States, which has given Cairo billions of dollars in military and other aid since it made peace with Israel in 1979.

The army might be pushing the opposition to join dialogue and Mursi to do more to draw them in, said Hassan Abu Taleb of the Al Ahram Center for Political and Strategic Studies.

He discounted the chance of direct military intervention, adding: "They realise that interfering again in a situation of civil combat will squeeze them between two rocks."

However, the military did seem poised to take a more active role in security arrangements for the December 15 referendum.

A cabinet source said the cabinet had discussed reviving the army's ability to make arrests if it were called upon to back up police, who are normally in charge of election security.

According to the state-run daily al-Ahram, an expanded military security role might extend to the next parliamentary election and, at the president's discretion, even beyond that.

The army issued its statement while protesters were still camped out by the gates of the presidential palace.

The tens of thousands of Mursi foes who surged past tanks and barbed wire to reach the palace gates on Friday night had dispersed. But a hard core stayed overnight in a score of tents.

"LEAVE"

Some had spray-painted "Down with Mursi" on tanks of the elite Republican Guard posted there after clashes between rival groups killed at least seven people and wounded 350 this week.

Others draped the tanks with posters of Mursi and the word "Leave" scored across his face in red letters.

"We are no longer calling for scrapping the decree and delaying the referendum," Samir Fayez, a Christian protester at the palace, said. "We have one demand in five letters: leave."

Nearby, a Mursi supporter named Mohamed Hassan was quietly observing the scene. He suggested that the Muslim Brotherhood and its ultra-orthodox Salafi Islamist allies could easily overwhelm their foes if they chose to mobilise their base.

"The Brotherhood and Salafis by themselves are few but they have millions of supporters who are at home and haven't taken it to the streets yet," murmured the 40-year-old engineer.

The Muslim Brotherhood's supreme guide, Mohamed Badie, denounced opposition protests that have swirled around the walls of Mursi's palace, saying they "ruin legitimacy".

Badie said eight people, all of them Brotherhood members, had been killed this week and urged the interior minister to explain why police had failed to prevent assailants from torching the organisation's headquarters and 28 other offices.

"Get angry with the Brotherhood and hate us as much as you like, but be reasonable and preserve Egypt's unity," he told a news conference. "We hope everyone gets back to dialogue."

The well-organised Brotherhood, which thrust Mursi from obscurity to power, remains his surest source of support.
